I know you all have the firm idea (as do I) that you shouldn't shoot through a closed door into an enclosed space. Especially when you don't know if it is your GF in there or an intruder. However the onus (as it is here) is on the Prosecution to present evidence and witnesses that leave the Judge (in SA, the Jury in UK) in NO DOUBT that the accused committed the crime. Unfortunately in the case of the prosecution the Judge threw out their two witnesses for unreliability. The evidence was not conclusive enough either for her to have given Oscar a Guilty Verdict in terms of Murder.

It is, as again it is here, the defence teams job to cast doubt, but where in the UK that is to cast doubt into one or two layman on a jury, in SA it is to cast doubt into a highly trained Lawyer/Judge. Therefore the "tricks" that an expensive team can use over here and in the States are unlikely to sway a highly trained individual.

It is a shame that Oscar Pistorious, a man who until this shooting was revered for all he had done for the Paralympic cause as well as the cause of Disabled people in general, is now seen as no more than a rich man who has got away with murder. I feel that he was able to afford a top defence team, but really the prosecution have let down everyone who wanted him convicted of murder.

The SA court process is IMO a better way of getting the true conviction, as the only person who makes the decision is trained in Law and therefore will only review the case and evidence based on how it contributes to the burden of proof. A jury of 12 peers who in this day and age will be all too eager to not be at court, and influenced all too heavily by press/social media cannot be the best way to try someone.

So you think the judge made the correct decision?

I would prefer a system which uses that of the majority than that of one especially in such cases as this one. That's why countries such as the UK and US implement this system hence the reason minor cases wont be seen by a jury unless requested by the defendant as in cases like this the judge can swiftly deal with facts but a case like the Pistorius case shouldn't be allowed to go so wrong. He has murdered his gf and disgracefully got away with it.
